3. NATURE OF SERVICE

Fuel//Matrix is an independent, privately operated information aggregation website. It compiles publicly available fuel price data from Australian government APIs and voluntary community reports and presents it in a searchable format.

Fuel//Matrix is NOT a government service. It is NOT affiliated with, endorsed by, or associated with any Australian federal, state, or territory government department or agency.

The information on this website is provided for general informational purposes only. It does not constitute advice of any kind.

4. DATA SOURCES

Fuel price and station data displayed on this website is sourced from:

(a) Government APIs, including the NSW Fuel Check API, WA FuelWatch, and other state and territory open data sources. Government data is provided by the relevant government agency under applicable open data licences. We do not control, create, or verify government data. We access it through publicly available interfaces and display it as received, subject to formatting and presentation changes.

(b) Community reports submitted by users. Community reports are unverified personal observations. We do not verify, confirm, or endorse community reports.

5. NO GUARANTEE OF ACCURACY

To the maximum extent permitted by law:

  • (a) We do not represent, warrant, or guarantee the accuracy, completeness, currency, reliability, or suitability of any information displayed on this website.
  • (b) Government data may be delayed, incomplete, contain errors, or be temporarily unavailable due to factors outside our control, including government system outages, reporting delays by stations, data transmission delays, and processing times.
  • (c) Community reports may be inaccurate, outdated, incomplete, misleading, or false.
  • (d) Fuel prices can change at any time without notice. A price displayed on this website may not reflect the current price at the pump.

6. NO GUARANTEE OF AVAILABILITY

We do not guarantee that this website will be available at all times or that it will be free from errors, defects, or interruptions. We may suspend, restrict, or discontinue the website or any part of it at any time without notice.

7. INFORMATION ONLY — NO RELIANCE

The information on this website is provided for general information purposes only. You must not rely on it as the sole basis for any decision. Before making any decision based on information displayed on this website — including but not limited to decisions about where to refuel, which route to take, or whether a station is open or has a particular fuel type available — you should independently confirm the relevant details directly with the service station.

8. USER RESPONSIBILITY

You are solely responsible for:

  • (a) evaluating the accuracy, completeness, and usefulness of any information obtained from this website;
  • (b) confirming any information directly with the relevant service station before acting on it;
  • (c) any decisions you make or actions you take based on information obtained from this website.

9. USER CONTENT AND COMMUNITY REPORTS

9.1 Submission Rules

If you submit a community report or any other user content, you agree that:

  • (a) your submission is your genuine personal observation, honestly and accurately reported to the best of your knowledge;
  • (b) you will not submit false, misleading, defamatory, obscene, offensive, or malicious information;
  • (c) you will not submit information that infringes any third party's intellectual property rights or other rights;
  • (d) you will not use the submission function to harass, threaten, or target any individual or business;
  • (e) you will not submit automated, bot-generated, or bulk submissions.

9.2 Licence

By submitting user content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, modify, adapt, publish, display, and distribute your submission in connection with the operation of this website. You waive any moral rights in your submission to the extent permitted by law.

9.3 No Obligation

We are not obliged to display, retain, or act on any user content. We may remove, edit, or refuse any submission at our sole discretion without notice or liability.

9.4 Display

Community reports will be displayed with the label “Community report — unverified” and will be visually distinguished from government-sourced data.

10. THIRD-PARTY AND GOVERNMENT API DATA

  • (a) Government data is provided by the relevant Australian government agencies under their respective open data licences. Our display of government data does not imply any endorsement, affiliation, or association with any government agency.
  • (b) We comply with the terms of each applicable open data licence, including attribution requirements. See our Data Sources page for details.
  • (c) We do not control government data. If government data is incorrect, we may direct you to the relevant government agency to request a correction at source.
  • (d) We may use other third-party data sources from time to time. Third-party data is subject to the same limitations as government data: we do not control, verify, or guarantee it.

11. LICENCE AND ATTRIBUTION COMPLIANCE

We display government data under the applicable open data licences. Attribution details are set out on our Data Sources page. If you believe we are not complying with the requirements of any data licence, please use the feedback form on the main page and we will investigate promptly.

12. WEBSITE AVAILABILITY

  • (a) This website is provided on an “as is” and “as available” basis.
  • (b) We do not guarantee uninterrupted, error-free, or secure access to this website.
  • (c) We may modify, suspend, or discontinue the website or any feature at any time without notice.
  • (d) We are not responsible for any loss or damage caused by any interruption, suspension, or discontinuation of the website.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

(a) We exclude all liability for any loss or damage (including but not limited to direct, indirect, incidental, consequential, special, or punitive loss or damage, loss of profits, loss of revenue, loss of data, loss of opportunity, or personal injury) arising out of or in connection with:

  • any community report or user content submitted by any user;

(b) If, notwithstanding the above, we are found to be liable for any loss or damage, our total aggregate liability to you for all claims arising out of or in connection with the website is limited to AUD $100.

14. AUSTRALIAN CONSUMER LAW

Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any equivalent state or territory legislation, which cannot be lawfully excluded, restricted, or modified.

If any guarantee, warranty, condition, or right cannot be excluded under Australian Consumer Law, our liability for breach is limited, at our option and to the maximum extent permitted by law, to:

  • (a) in the case of services: re-supply of the services, or payment of the cost of having the services re-supplied; and
  • (b) in the case of goods: replacement of the goods, supply of equivalent goods, repair of the goods, or payment of the cost of replacement, supply, or repair.

15. INDEMNITY

You agree to indemnify, defend, and hold harmless Fuel//Matrix, its operator, and its officers, employees, contractors, and agents from and against any and all claims, demands, actions, suits, proceedings, liabilities, losses, damages, costs, and expenses (including reasonable legal costs on a solicitor-client basis) arising out of or in connection with:

  • (a) your use of or access to this website;
  • (b) any breach by you of these Terms;
  • (c) any user content submitted by you;
  • (d) any violation by you of any law or regulation;
  • (e) any infringement by you of any third-party right.

16. INTELLECTUAL PROPERTY

(a) Our IP. All content on this website (excluding government data displayed under licence and user content) — including but not limited to the website design, layout, graphics, logos, code, trade marks, and text — is owned by or licensed to us and is protected by Australian and international intellectual property laws. You may not reproduce, copy, distribute, publish, or create derivative works from any part of this website without our prior written consent.

(b) Government data. Government data is displayed under the terms of the applicable open data licences. Your use of government data obtained through this website must comply with those licences.

(c) Trade marks. “Fuel//Matrix” and the Fuel//Matrix logo are trade marks of the operator. All other trade marks are the property of their respective owners.

17. ANTI-SCRAPING, ANTI-REPUBLICATION, AND ANTI-FEED EXTRACTION

(a) You must not, without our prior written consent:

  • scrape, crawl, spider, harvest, or use any automated means to access, extract, collect, or copy any content, data, or information from this website;
  • reproduce, republish, redistribute, licence, sell, or make available any content, data, or information from this website to any third party;
  • create, compile, or build any database, directory, collection, or dataset using content or data from this website;
  • create any derivative work, product, service, application, or website that incorporates, is based on, or competes with this website using data obtained from it;
  • access this website in any manner that could damage, disable, overburden, or impair it;
  • use any robot, spider, scraper, automated tool, or manual process to monitor, extract, or copy content from this website;
  • frame, mirror, or deep-link to this website or any part of it;
  • reverse-engineer, decompile, or disassemble any part of this website;
  • extract, collect, or harvest any data feeds, price feeds, or data streams;
  • systematically download or cache content for offline or commercial use.

(b) We actively monitor for scraping and automated access. We reserve the right to block, restrict, or terminate access for any user or IP address that we reasonably suspect is engaging in any of the above activities.

(c) Any data obtained through scraping or other unauthorised means is obtained in breach of these Terms. You agree that any such data must be deleted immediately upon our request and that we may pursue all available legal remedies.

18. PRIVACY

Your use of this website is also subject to our Privacy Policy, which forms part of these Terms.

19. CORRECTION AND TAKEDOWN PROCESS

  • (a) If you are a service station owner or operator and believe that information displayed about your station is incorrect, please use the feedback form on the main page. We will endeavour to review and respond within 5 business days.
  • (b) If you believe any content on this website infringes your intellectual property rights, please use the feedback form on the main page with details of the alleged infringement. We will investigate and, where appropriate, remove or amend the content.
  • (c) We reserve the right to remove, amend, or refuse any content at our sole discretion.

20. CHANGES TO THESE TERMS

We may update these Terms at any time by publishing revised Terms on this page. Changes take effect when published. We will update the “Last updated” date at the top of this page. Your continued use of the website after changes are published constitutes acceptance of the updated Terms.

Where we make material changes, we may (but are not obliged to) notify you by displaying a notice on the website or re-displaying the acceptance modal.

21. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and us regarding the use of this website.

23. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal from them.
